This Agreement constitutes a public offer by LLC "SIES" (virtual marketplace operator, hereinafter — the Marketplace Operator), which manages the Sies.kg platform. The Sies.kg platform is a "Digital Marketplace Operator" within the meaning of the Digital Code of the Kyrgyz Republic. The Marketplace Operator acts as an Agent of the Users. The Agent undertakes to provide a digital environment for concluding transactions and to guarantee the security of settlements through the Digital Escrow mechanism.

 

This User Agreement governs the relationship between the Marketplace Operator) and the Internet user (hereinafter – the "User"), arising from the use of the Internet resource www.sies.kg (hereinafter — Sies.kg), on the terms specified in the User Agreement.

 

Full and unconditional acceptance of this offer by the Marketplace Operator to the User to conclude the Agreement is the User's performance of actions aimed at using Sies.kg, including searching, viewing or submitting listings, registering on the site, sending messages through the contact form and other actions involving the use of Sies.kg functionality

 

The User Agreement may be amended by the Marketplace Operator at any time without any special notice to the User. The new version of the User Agreement enters into force from the moment it is posted on Sies.kg, unless the Marketplace Operator expressly states otherwise. It is the User's obligation to regularly review the current version of the User Agreement.

 

The User's use of the Marketplace Operator after the new version of the User Agreement enters into force means the User's consent to it and the application to the User in full of the provisions of the new version.

1. Terms and definitions

 

In this User Agreement, the terms listed below have the following meaning:

 

Sies.kg — an Internet resource representing a set of information and intellectual property objects contained in the information system (including, among other things, computer software, a database, the graphical design of the interface (design), etc.), access to which is provided from various user devices connected to the Internet through special software for viewing web pages (a browser) at the addresses www.sies.kg, sies.kg and (including subdomains relating to these addresses) or the Sies.kg Mobile Applications.

 

User — a visitor to Internet resources, including Sies.kg.

 

Services — functional capabilities, services, tools available to Users on Sies.kg.

 

Mobile Application — software for portable (mobile) devices installed or downloaded by the User on such devices through various software platforms, intended for access to Sies.kg.

 

Product — any product, item, or service in respect of which the User posts a Listing on Sies.kg. Listing — an informational message with an offer concerning a Product (including contact information, photographs and any related information), posted by the User on Sies.kg and addressed to an indefinite circle of persons.

 

Seller — a User who posts a Listing on Sies.kg with an offer to conclude a transaction in respect of a Product.

 

Buyer — a User who views a Listing posted by the Seller, interacts with the Seller in respect of the Product and/or concludes a transaction with the Seller.

 

Account Credentials — a unique login (email address or phone number) and password created independently by the User during Registration on Sies.kg or subsequently changed by the User through the Personal Account, used to access the Personal Account after the User's authorization on Sies.kg.

 

Personal Account — the User's personal section on Sies.kg associated with the User's account on Sies.kg, in which the User can manage individual Sies.kg Services.

 

Information — any materials and information provided by the User in connection with the use of Sies.kg.

 

Digital Signature – information in digital form that is attached to other information in digital form and/or logically associated with it and is used to ensure the immutability of a digital document and to identify the author of a digital document;

 

2. General provisions. Access to services

 

2.1. The Marketplace Operator offers the User, on the terms of this User Agreement, to use the Services available on Sies.kg, including posting, searching and viewing Listings and other Services offered on Sies.kg. Additional terms, rules and restrictions may be established by the Marketplace Operator for the use of individual Services. The Marketplace Operator may at any time review or amend the terms of provision of the Services, supplement, change, limit, or expand the functionality of Sies.kg and/or the Services, including the terms of the User's access to the Services or individual features of Sies.kg.

 

2.2. The Services are provided to the User free of charge unless otherwise expressly stated.

 

2.3. Sies.kg is a platform that allows Sellers, on their own responsibility, to post offers addressed to an indefinite circle of persons to conclude a transaction in respect of a Product that the Seller is entitled to dispose of (make offers), and allows Buyers, at their own discretion and on their own responsibility, to accept offers posted on Sies.kg by Sellers by concluding the relevant transaction with the Seller.

 

2.4. The Marketplace Operator is not the organizer of the transaction, the Buyer, the Seller, an intermediary, agent or representative of any User and/or other interested party in respect of the transaction offered/concluded between Users. All transactions between Users concluded by virtue of posting a Listing on Sies.kg are concluded and performed without the direct or indirect participation of the Marketplace Operator. ?

 

2.5. Regardless of whether the User is registered or authorized on Sies.kg, use of Sies.kg, including viewing information posted on Sies.kg, means the User's consent to this User Agreement and acceptance of the obligation to follow the instructions for using the Services, as well as responsibility for actions related to the use of Sies.kg.

 

2.6. By accessing Sies.kg and thereby concluding this User Agreement, the User warrants that they possess all rights and powers necessary to conclude and perform the User Agreement, including that they are an adult and fully capable person, or a minor declared fully capable by decision of the authorized body, or a minor who has reached the age of fourteen and has obtained written permission in the form required by law from their parents or other legal representatives to conclude the User Agreement. Sies.kg may at any time require the User to provide information and documents confirming the rights and powers as stated above.

 

2.7. The Services provided on Sies.kg may at any time be changed, supplemented, updated, or altered in form and nature of functionality without prior notice to the User; accordingly, their use is offered on an "as is" basis, i.e. in the form and scope in which they are provided by Sies.kg at the moment the Users access the Services. Sies.kg may, if necessary, at its sole discretion terminate (temporarily or permanently) the provision of the Services (or any individual functions within the Services) to all Users in general or to an individual User, in particular, without prior notice.

 

3. Registration and digital profile on Sies.kg

 

3.1. During Registration, Account Credentials are specified, which the User chooses independently. After entering the data for Registration, the User receives an email or SMS to the email address or phone number specified during Registration, containing the code necessary to confirm Registration on Sies.kg. At the same time, account registration is carried out once for one email address of the User. Re-registration of a new account on Sies.kg using an email address previously specified during Registration is not permitted.

 

3.2. The User must safeguard their Account Credentials and not disclose them to third parties. The User may not transfer their Account Credentials to third parties, nor directly or indirectly permit third parties to use their Account Credentials to authorize on Sies.kg, except for persons acting on behalf of and in the interests of the User or who have received such Account Credentials on the basis of relevant agreements with the User.

 

3.3. Any action performed from the User's Personal Account using their Account Credentials is deemed to be an action performed by the User themselves or by a person authorized by them and establishes obligations and liability for the User in respect of such actions, including liability for violation of this User Agreement and legal requirements in respect of the Product, information about which is posted by the User on Sies.kg.

 

3.4. The User must immediately change their Account Credentials if they have reason to suspect that these data have been disclosed or may be used by third parties not authorized by them.

 

3.5. Sies.kg may use available technical solutions to verify the accuracy of information provided by the User when using Sies.kg. Sies.kg cannot guarantee that the User is actually the person they represent themselves to be, or that the information provided by the User on Sies.kg corresponds to reality. Sies.kg recommends that Users communicate with potential counterparties, Sellers and Buyers using all tools available on Sies.kg, and exercise due care and caution when concluding transactions and choosing a Seller.

 

3.6. Sies.kg may block the User's access to the Personal Account with simultaneous cessation of posting and display of their Listings or without such cessation if the User violates the terms of this Agreement and/or the rules for posting listings. Sies.kg may at any time terminate and/or restrict the User's access to the Services, as well as block or delete the User's account on Sies.kg without the possibility of recovery.

 

3.7. Viewing Listings and other information posted on Sies.kg in open access does not require the User's registration and/or authorization; however, when performing such actions the User is in any case obliged to comply with the provisions of the User Agreement.

 

3.8. The User understands and agrees that when going through the registration procedure on the site and/or in the mobile application www.sies.kg. the User and the Marketplace Operator may use the mobile phone number and email address initially entered by them on www.sies.kg, and also automatically undertakes to comply with the user agreements of the site and mobile application.

 

3.9. Access to trading is granted to the User after verification (KYC). The User is obliged to integrate their "Digital Profile" when concluding transactions.

 

3.10. All legally significant actions on Sies.kg are performed by Users using Cloud Electronic Signature (CES). The parties acknowledge that documents signed with CES in the Sies.kg interface are equivalent to paper documents with an official stamp.

 

4. General posting rules

 

4.1. Listings must not contain information that is prohibited or contrary to the legislation of the Kyrgyz Republic.

 

4.2. Posted listings undergo moderation — a check for correct completion and compliance with these rules.

 

4.3. Post accurate information:

 

4.3.1. it is necessary to provide accurate information in the listing (price, phone numbers, specifications, photographs, etc.);

 

4.3.2. the content of the listing must correspond to the category in which it is submitted. Moderators have the right to delete a listing if it does not comply with the rules for publishing listings in the submitted category;

 

4.4. Prohibited:

 

4.4.1. publishing listings similar in content where it is obvious that they concern the same offer in the same city (regardless of the date of their publication)

 

4.4.2. expressing discrimination on racial, national, religious, or social grounds, propaganda of violence or hatred;

 

4.4.3. the User who posted the listing is responsible for the information contained in the listing.

 

4.5. Sies.kg bears no responsibility for transactions concluded by Users.

 

4.6. listings that do not comply with these rules may at any time be deleted or corrected by the site administration without the permission and notification of the author of the listing.

 

4.7. suspicious activity in submitting listings results in account blocking.

 

4.8. comments on listings and articles that do not comply with these rules and the Law of the Kyrgyz Republic "On Mass Media" may at any time be deleted or corrected by the site administration without the permission and notification of the author of the listing.

 

4.9. the period for posting listings on the site is 90 days from the moment of submission (or from the moment of its renewal).?

 

5. Listing title and text

 

5.1. Listing text is permitted only in Russian and/or Kyrgyz

 

5.2. Capitalization must be as in sentences (first letter uppercase, the rest lowercase).

 

5.3. Transliteration (writing words in Latin letters) is prohibited.

 

5.4. The fields of the listing submission form must be completed in accordance with their names.

 

5.5. Phone numbers must be indicated in the site's format.

5.6. Prohibited:

 

5.6.1. posting listings in the title or text of which there are repeated punctuation marks and/or non-letter symbols.

 

5.6.2. posting listings in the description of which there is information about a company and the services it provides. The exception

is Companies.

 

5.6.3. indicating links to any websites or email addresses other than the sies.kg website,

 

5.6.4. indicating address and business hours in the text of the listing.

 

6. Rules for publishing images?

 

6.1. The use in listings of images that violate the right to privacy or images the publication of which in one way or another contradicts the legislation of the Kyrgyz Republic is prohibited.

 

6.2. To ensure compliance with the rules for publishing listings and prompt removal of images that do not comply with the service rules, all images are checked by moderators.

 

6.3. Images that contradict these rules are deleted as they are discovered.

 

6.4. The Service is not responsible for the content of images (files) published in listings.

 

6.5. Rights to images in listings belong to their owners.

 

6.6. Image size must be at least 400×300 pixels.

 

6.7. Images must be in JPEG or PNG format.

 

6.8. Posting trademarks, logos, trade names on photographs, the rights to which belong to third parties, except in cases separately specified in the rules for posting listings.

 

6.9. The image must not contain:

• watermarks, logos of any resources other than sies.kg;
• contact information (phone numbers, e-mail, contact details for Skype, WhatsApp, Viber and other messaging services);
• information about price, credit, installment plans and promotional offers;
• "festive" design and frames;
• names and addresses of websites;
• state symbols;
• fragments of erotic content;
• QR codes;
• native advertising materials (logos and names of third-party resources).

 

6.10. People may be depicted in photographs if they have given oral and/or written consent to the publication of such an image or if such an image is part of advertising for a product that was placed on the market by the rights holder or with their consent.

 

6.11. Copying images belonging to other users of the resource is prohibited.

 

6.12. The image must correspond to the item being sold or the service being provided.

 

6.13. Photographs must be unique. Use of photographs previously posted by other users is prohibited.

 

7. Subject matter of listings prohibited from publication on the resource

 

7.1. Any activity related to weapons (including mock-ups, replicas, toy weapons, etc.).

 

7.2. Eavesdropping devices.

 

7.3. Purchase and sale of documents and license plates (state registration plates).

 

7.4. Sale of organs for transplantation.

 

7.5. Products and services of the sex industry.

 

7.6. Sale of alcoholic beverages and cigarettes.

 

7.7. Dubious services: financial pyramids, network marketing, gambling, sale of information about fixed matches, fortune-telling, predictions and other similar services.

 

7.8. Products/services the use of which may be aimed at violating the current legislation of the Kyrgyz Republic.

 

8. Special rules for companies and specialists

 

8.1. Duplication of profiles is prohibited

 

8.1.1. If you already have a profile, do not create an additional one. Such actions will be stopped by the moderator, and additional profiles will be deleted. Copying information from other users' profiles is also prohibited.

 

8.1.2. Only one company account per legal entity is permitted; duplicates will be deleted without refund.

 

8.2. Tell the truth about yourself

 

8.2.1. Fill in your profile with accurate data. People trust you more when you are honest with them.

 

8.3. About filling in the profile

 

8.3.1. Password: create a strong password; simple ones such as "123456" are easy to guess, and you may lose access to your account.

 

8.3.2. Names: use your real first and last name. Forum nicknames, random symbols, etc. are not permitted.

 

8.3.3. Company names: the full and exact name must be indicated in accordance with the data specified in the founding documents, with indication of its legal form.

 

8.3.4. Only one business account is permitted per company; its name must match the company name.

 

9. Liability for non-compliance with listing posting rules

 

9.1. For non-compliance with these rules, as well as for activity that harms the operation of the site, the administration reserves the right

• to block the personal account with subsequent deletion of all listings without compensation;
• to add the user's email and phone number to the "blacklist" for systematic violation of the rules.

 

9.2. The site administration may at any time change or supplement the "Rules for posting listings" without any prior notice to users.

 

10. Paid services

11. Transaction mechanism: Digital Escrow

 

11.1. After acceptance of the lot, the User — Buyer transfers funds to the Operator's transit account.

 

11.2. The Operator notifies the User — Seller of the deposit of funds. From that moment, the obligation of the User — Buyer to pay is deemed fulfilled to the Agent.

 

11.3. Release of the escrow: the Operator transfers funds to the User — Seller within 24 hours after one of the following events is recorded in the system:

• confirmation of receipt of goods by scanning the QR code on the delivery note.
• registration of the Electronic Invoice (EI) in the STS database pulled through the API.
• other types of settlements if the parties to the transaction are non-residents of the Kyrgyz Republic.

 

11.45 In the event of a dispute, funds are blocked until a decision by the Platform Arbitration.

 

12. Tariffs and commission remuneration

 

12.1. For performing agency functions, Sies.kg withholds a commission from the amount of each completed transaction. The amount of remuneration varies depending on the nature of the product and transaction and is governed by the price list in the Personal Account.

 

12.2. The commission is withheld automatically at the moment funds are transferred to the User — Seller.

 

12.3. The cost of additional services (lot promotion, analytics) is governed by a separate price list in the Personal Account.?

 

13. Dispute resolution (Arbitration)

 

13.1. All disputes are resolved through negotiations with the participation of a Sies.kg mediator.

 

13.2. If no agreement is reached, the dispute is referred for consideration to the International Arbitration Court at the Chamber of Commerce and Industry of the Kyrgyz Republic (Bishkek) in accordance with its Rules. Applicable law — the legislation of the Kyrgyz Republic and the Digital Code of the Kyrgyz Republic.

 

14. Privacy Policy

 

14.1. Legal basis:

The Policy complies with Articles 49-61 of the Digital Code of the Kyrgyz Republic and the Law of the Kyrgyz Republic "On Personal Information".

 

14.2. Collection and processing of "Digital Traces"

 

14.2.1. In addition to personal data, Sies.kg collects metadata: IP addresses, transaction logs, hash sums of signed documents and parameters of electronic devices.

 

14.2.2. The Operator uses "Sandbox" technology to process data, excluding unauthorized access by third parties.

 

14.3. Purpose of use

 

Data is processed exclusively for:

• ensuring operation of the escrow mechanism.
• counterparty verification (Due Diligence) through government registers.

 

Compliance with legal requirements on AML/CFT (anti-money laundering and countering the financing of terrorism).

 

14.4. User data and cross-border data transfer

 

If a non-resident of the Kyrgyz Republic participates in a transaction, data may be transferred abroad only on condition that adequate data protection is ensured in the recipient country, according to the "Whitelist" of the authorized body of the Kyrgyz Republic.

 

14.5.1. In the course of using Sies.kg, the User undertakes to provide only accurate Information and bears full responsibility for the information provided. The User undertakes to update Information in a timely manner by editing it on Sies.kg. The Marketplace Operator may request, and the User must provide upon such request, documents and information necessary to identify the User as a party to the User Agreement and/or as a party using the relevant Service, as well as documents confirming the accuracy of the Information provided and the lawfulness of use/offer of the Product and/or the User's connection with the Product specified in the Listing.

 

14.5.2. In the process of using Sies.kg Services (including during Registration, interaction with other Users through the Sies.kg interface, posting Listings, viewing Sies.kg pages, etc.), the User independently and voluntarily decides to provide the Marketplace Operator or place in open access personal and other information about the User (surname, first name, patronymic or pseudonym of the User, email address, mobile phone number, as well as any other information provided by the User, including contained in messages sent to other Users through the feedback form in the Sies.kg interface, and comments sent through the form for adding a comment to a Listing, etc.) for the purposes of performance of the User Agreement, and hereby declares their consent to processing by the Marketplace Operator of the User's personal and other data, including for the purposes of: providing advisory support to Users in connection with the use of Sies.kg, checking Listings for compliance with the User Agreement, delivering messages to other Users, obtaining statistical and analytical data to improve the operation of Sies.kg and/or the Services, expanding the range of Services provided, receiving informational and/or advertising messages from the Marketplace Operator or third parties, preventing or stopping unlawful and/or unauthorized actions by Users or third parties, ensuring compliance with the requirements of the current legislation of the Kyrgyz Republic. The Marketplace Operator takes all necessary measures to protect the User's personal data from unauthorized access by third parties.

 

14.5.3. All information posted by the User on Sies.kg is posted by them for the User to dispose of their property and/or services and/or for other interests of the User and, accordingly, the User posts certain information about themselves exclusively in their own interests, including to facilitate establishing contact with the User.

 

14.5.4. By posting Listings on Sies.kg, the User makes the Information specified in the Listing publicly available and understands that the posted information is published on Sies.kg in open access, i.e. available for review by any visitor to Sies.kg (an unlimited circle of persons) in all countries of the world where Internet use and access to the site are possible; accordingly, the User understands and accepts all risks associated with such posting of information, including, but not limited to: the risk of the email address being added to lists for spam mailings, the risk of the email address falling into the hands of various kinds of fraudsters, the risk of the phone number falling into the hands of SMS spammers and/or SMS fraudsters and other risks arising from such posting of information.

 

14.5.5. The Marketplace Operator is not obliged to carry out prior verification of Information of any kind posted and/or distributed by the User through Sies.kg. The Marketplace Operator has the right at its discretion to refuse the User to post and/or distribute any Information or to delete any Information posted by the User on Sies.kg. The User understands and agrees that they must independently assess all risks associated with posting and distributing any Information, including assessing the reliability, completeness or usefulness thereof.

 

14.5.6. The Marketplace Operator may not consider User inquiries: that do not contain information and documents necessary for consideration of the inquiry; that contain false information and/or documents lacking signs of authenticity; concerning issues on which the Marketplace Operator has previously sent a response to the User (repeat inquiries); containing insults, threats or inquiries expressed in harsh negative form; sent in violation of other terms and procedures for consideration of inquiries provided by the Marketplace Operator.

 

14.5.7. The User agrees that the Marketplace Operator may collect anonymized statistical data about Sies.kg Users. The User agrees to the transfer to third parties of anonymized statistical data, including for the purposes of their processing, to ensure the operation of Sies.kg, the Services, and the implementation of partnership and other Sies.kg programs. The purpose of processing the User's data is to provide the User with the ability to use the Services and grant rights to use additional functional (software) capabilities of Sies.kg, conduct advertising campaigns, provide targeted advertising and Services, conduct statistical research and analysis of obtained statistical data, and perform other actions described in the User Agreement.

 

15. User obligations

 

15.1. The User undertakes to act exclusively in accordance with current legislation and the Sies.kg User Agreement, and to bear full responsibility under the legislation of the Kyrgyz Republic for their own actions and inaction on Sies.kg and when using the Services.

 

15.2. The Sies.kg Services available to the User may be used exclusively for the purposes for which such Services are intended by the Marketplace Operator. The User is prohibited from using the Services and any information obtained on Sies.kg for purposes other than intended.

 

15.3. The User undertakes not to use automatic and other programs to gain access to Sies.kg without written permission from the Marketplace Operator. Without permission from the Marketplace Operator, use, distribution, copying and/or extraction from Sies.kg by manual or automatic means (using software tools) of any materials or information (including Listings, product description texts, photographs, etc.) is also not permitted.

 

15.4. Use of computer programs that allow viewing or posting Listings on Sies.kg bypassing the usual procedure for posting Listings (for example, use of auto-upload programs for Listings), in the absence of written permission from the Marketplace Operator, is strictly prohibited and may result in termination and/or suspension of publication of Listings, blocking of access to the Personal Account and/or to Sies.kg.

 

15.5. The User also undertakes:

• not to take any actions that may lead to a disproportionately large load on the Sies.kg infrastructure;
• not to copy, reproduce, modify, distribute or present to the public any information contained on Sies.kg (except Information provided by the User themselves) without prior written permission from the Marketplace Operator and any third party;
• not to interfere with the operation of Sies.kg, and not to interfere with the operation of automatic systems or processes aimed at blocking or restricting access to Sies.kg.

 

15.6. In order to stop or prevent violation of the User Agreement and/or causing damage to the Marketplace Operator (for example, DDoS attacks or other hacker attacks, unauthorized use by the Marketplace Operator of software tools, including for uploading Listings, etc.), the Marketplace Operator may restrict access of Users or third parties to Sies.kg by blocking access to Sies.kg from the relevant IP address or range of IP addresses.

 

15.7. By accessing Sies.kg, the User expresses their consent to receive advertising information posted on Sies.kg by third parties. The User understands and agrees that Sies.kg does not determine the content and is not responsible for such information, including websites and links.

 

15.8. The Sies.kg User undertakes not to use any data provided by another User without written permission from the person who posted such Information or without confirmation by any other means of the right to use such Information. All information obtained by the User about other Users in connection with the use of Sies.kg may be used only for concluding and performing transactions in respect of Products. Thus, the User is prohibited from using the email address and/or phone number of another User, personal messaging services and comments for direct advertising mailings or other mailings of unwanted electronic messages, as well as for other unlawful actions or actions performed without the knowledge and/or consent of the other party.

 

15.9. If the User has claims against another User in connection with the latter's use of the Services and/or Listings posted by them, the User must present these claims to the proper person (Seller) and resolve the claims independently and without the participation of the Marketplace Operator.

 

15.10. The User understands and accepts that the Marketplace Operator does not always verify information published on Sies.kg by Users. Some data contained in Listings may seem offensive, dangerous, incorrect or misleading. Users are advised to exercise caution and rely on common sense when using information on Sies.kg. The User should take into account that their counterparty may impersonate another person, be a minor, post distorted information, etc. Use of the Services implies that the User is aware of and accepts these risks, and also agrees that the Marketplace Operator is not responsible for actions or inaction on the part of other Users.

 

15.11. The User undertakes to exercise due care when choosing a counterparty, accepts the decision on a transaction at their own responsibility based on the fact of posting a Listing on Sies.kg, independently verifying that the offer, sale and/or purchase of any Product in a Listing on Sies.kg is valid and lawful.

 

16. Warranties and liability

 

16.1. The User is liable for actions performed on Sies.kg in accordance with the current legislation of the Kyrgyz Republic, including liability for the content of information posted by them, prohibited information and violation of third-party rights in respect of Products and/or information posted on Sies.kg.

 

16.2. Prohibited content is content that:

• Violates the current legislation of the Kyrgyz Republic.
• Contains pornographic materials.
• Incites war, violence or inflames interethnic, religious or social hatred.
• Contains extremist, terrorist or other materials that undermine public order.
• Violates the rights of third parties, including copyright, property, privacy and other rights.

 

16.3. Sies.kg reserves the right:

• To delete or block content that violates clause 11.2, without prior notice to the User.
• To transfer information about violations to competent government authorities when grounds provided by law exist.

 

16.4. A User who has posted prohibited content:

• Bears responsibility for all consequences, including compensation for damage caused to third parties or Sies.kg.
• May be deprived of the right of access to Sies.kg services unilaterally.
• May be subject to legal liability in accordance with the legislation of the Kyrgyz Republic.

 

16.5. The User is responsible for offers in respect of Products and transactions concluded in connection therewith, for the choice of counterparties for the transaction and the consequences arising from the transaction. All transactions in respect of Products are concluded directly between Users. The Marketplace Operator is not a participant and/or intermediary in transactions concluded by Users based on information obtained on Sies.kg, does not control and is not responsible for such transactions.

 

16.6. Sies.kg is a tool that provides Users with the ability to post Listings in respect of Products the sale and/or purchase of which is permitted by law and the User Agreement. At the same time, the Marketplace Operator does not always verify Listings posted by Users. Thus, the quality, safety, legality and conformity of the Product to its description, as well as the Seller's ability to sell and/or the Buyer's ability to purchase the Product are beyond the control of the Marketplace Operator. In this regard, the Marketplace Operator is not responsible for the content of information provided by Users, including the content of Listings, Users' use of third-party trademarks and logos and the Seller's offer terms.

 

16.7. Given the principles of construction and operation of the Internet, the Services are provided "as is", which means that the Marketplace Operator does not provide any warranties in respect of the Services; in particular, the Marketplace Operator does not guarantee the User that:

• the Services, their direct or indirect effect and quality will meet the User's requirements and objectives;
• the Services will be provided continuously, reliably and without errors;
• the results obtained through use of the Services will be accurate, reliable and meet the User's expectations.

 

16.8. The User agrees that the Marketplace Operator is not liable for possible losses caused to the User in connection with measures taken to stop or prevent violations on Sies.kg related to restriction/blocking of Users' access to Sies.kg.

 

16.9. The Marketplace Operator is in no way associated with any information provided by the User, including the content of Listings provided and/or posted by Users on Sies.kg, and is not obliged to verify the content, authenticity and safety of such information or its components, or its compliance with the requirements of current legislation and the Users' possession of the necessary scope of rights to distribute and/or use it.

 

16.10. Sies.kg. is not responsible for the content of contextual advertising posted on the Sies.kg website or mobile application. If the advertising contains content prohibited by law, including, but not limited to, incitement to violence, extremism, distribution of pornography or other materials violating legal norms or public morality, all responsibility for such content lies exclusively with the advertising network providing such advertising.

 

17. Intellectual property rights

 

17.1. The holder of exclusive rights to Sies.kg and the Mobile Applications, including, but not limited to, the domain name, the logo posted on Sies.kg, the Sies.kg trademark, databases, and all technical developments enabling the use of Sies.kg is the Marketplace Operator. The User or other person may not use Sies.kg, the Mobile Applications or the Services in ways not provided for by this User Agreement without written permission from the Marketplace Operator, including extracting Information in any form by means not provided for by the User Agreement.

 

17.2. Information and news materials of the site, the copyrights to which belong to the Marketplace Operator, may be reproduced in any mass media, on Internet network servers provided there is a reference to Sies.kg; when posted on the Internet, an active hyperlink to Sies.kg is mandatory.

 

17.3. Exclusive rights to the results of intellectual activity included in the Information provided by Users belong to the respective Users and rights holders.

 

17.4. For the purposes of performance of this User Agreement, conducting contests, promotions, announcing and informing Users and other similar events, exercising lawful rights and interests of the Marketplace Operator and ensuring the operation of Sies.kg, the User grants the Marketplace Operator a valid worldwide, perpetual right to use the Information (including photographs, product description texts, trademarks, logos, etc.) in any manner on all known or unknown information carriers for the entire term of the exclusive right, as well as to transfer such right to third parties. The User permits use of materials included in the Information without indicating the author's name, and also warrants that the Information provided does not violate any rights of third parties, including exclusive rights.

 

18. Term of the User Agreement

 

18.1. This User Agreement enters into force from the moment the User begins using Sies.kg Services, regardless of whether the User is registered or has posted a Listing on Sies.kg, and is valid indefinitely.

CONSENT TO THE PROCESSING AND TRANSFER OF PERSONAL DATA

 

I, a registered user of Sies.kg, hereby give my consent to the Operator for the following actions:

 

GIS Integration: I authorize the Operator to request my data from government information systems (SE "Infocom", STS, Ministry of Justice) to confirm my legal capacity.

 

Transfer to Banks: I confirm my consent to the transfer of my identification data to Sies.kg partner banks for opening virtual accounts and conducting escrow settlements.

 

Automated decision: I agree that the decision on admission to trading may be made by automated scoring systems of the Platform based on analysis of my data.

 

Term: This consent is valid indefinitely. I am notified of the right to withdraw consent through the Personal Account settings, which will result in immediate termination of access to the transaction closing functionality.

 

Legal force: Confirmation of this consent by clicking the "Accept" button in the Sies.kg interface is recognized by me as use of CES and has full legal force.
